These
Terms of Service apply to Inernet Information Inc
and Carter Business Services (CBS) Members or any
other person authorized by the Member to use his/her
account.
DEFINITIONS:
In these Terms of Service "CBS" means
Carter Business Services Inc, "Member or You" means
anyone who has an account / membership with CBS.

In
the Internet Access Services, a member is allowed to use the
computer in the domain "CBS Systems", and any other
related domains to connect to the Internet in order to use Internet
services such as electronic mail, database searches, etc. at
CBS, and other networks all over the world.
The services at CBS are provided for sending and receiving information
for business, commerce, education and research for economic
and social development.
- The member agrees to abide by all the rules, regulations,
netiquette already existing or to be announced later at CBS. At
least, the member agrees not to use the Internet to violate the privacy of any other
person, no matter whether or not there is any protection on any part of the system or not.
The member agrees not to distribute a private E-Mail to any other person without having
permission from that person. The member may not use any impolite language and/or
defamatory message in the public part of the network, such as in any newsgroup or mailing
list. If the member violates netiquette, he/she agrees to accept all the responsibilities
and consequential liability. CBS will not share any responsibility or charges with the
member. The member agrees to take all measures necessary and desirable to keep his/her
password secret. Members agree to change his/her password as often as necessary and
desirable.
- In the services from CBS, the member is not allowed to send
or receive government secret or illegal information (such as copyrighted information for
which the member has not received permission or information, which is threatening or
defamatory or obscene, etc.). The member agrees that if he/she is accused of breaking the
law, would not hold CBS responsible in any aspect at all. In CBS services, the member is
not allowed to let any other person use his/her account, or lease or sale the usage of
his/her account to any other individual or institute.
- A member is not allowed to use CBS to break into and/or
using any services and facility connected to the Internet where he/she is not authorized
to do so.
- Warranties
- Except for certain products and services specifically
identified as being offered by CBS, CBS does not control any information, products or
services on the Internet and except for such CBS-identified content, all merchandise,
information and services offered, made available, or accessible on the Internet are by
third parties who are not affiliated with CBS.
- Members assume full responsibility
and risk for use of the service and the Internet. The service
is provided on an "as is" and "as
available" basis. CBS does not warrant that the service
will be uninterrupted or error-free or that any information,
software or other material accessible via the service
is free of viruses, worms, trojan horses, or other harmful components.
CBS makes no express or implied warranties, representations or
endorsements including, but not limited
to, warranties of title, non-infringement or implied warranties
of merchantability or fitness for a particular purpose regarding
any merchandise, information or service
provided through CBS or on the internet generally. No advice
or information given by CBS, its employees, affiliates or contractors
shall create a warranty.
- CBS shall not be liable for any costs or damages arising
directly or indirectly from use of the service. It is solely member's responsibility to
evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, and
other information, and the quality and merchantability of all merchandise provided through
the service or on the Internet generally. CBS is not liable for any damages may caused by
the quality of the communication circuit, installation disks/CDs or any other media and/or
software, by non-delivery of messages and/or files or delivery to wrong place, or damage
to messages and/or files, or damages caused by any other member.
- Under no circumstances shall CBS, its Employees, Affiliates
or Contractors be liable for any direct, indirect, incidental, special, punitive, or
consequential damages that result in any way from any: use of your account or the service
or your inability to use the service; access of the internet or any part thereof; or, your
reliance on or use of information, services or merchandise provided on or through the
service or that result from mistakes, omissions, interruptions, deletion of files, errors,
defects, delays in operation or transmission, or any failure of performance.
- The Internet contains unedited materials, some of which are
sexually explicit or may be offensive to member or others accessing the service through
his/her account. Members access such materials and permit others to access such materials
through his/her account at his/her own risk. CBS has no control over and accepts no
responsibility for such materials.
- CBS reserves the right to deny membership to any applicant
without having to give any explanation, and reserves the right to suspend or cancel the
membership and usage of the system to any member who violated or attempted to violate the
rules, regulations, and netiquette without having to give any advance notice.
- CBS will try to grant the login
ID as requested by the applicant but reserves the right to assign
another ID if the requested ID is the same as
another existing one or not suitable. CBS will install access and
other required software on only one Computer System identified
by the member. This computer system must be in full
working order and possess all the necessary hardware and software
to access the internet, including but not limited to: Monitor,
Mouse, Keyboard, sufficient RAM & free Disk
Space, CD-ROM drive, Floppy Drive, Modem, working Phone Line attached
to the modem.
- CBS reserves the right to change the rates and details of
service without prior notice and the changes may be retroactive according to the order or
announcement from InterNet Information Inc or CBS Systems and/or other government authority.
- Credit Policy
- The last date of payment is the 15th day of the month,
following the month for which the bill has been issued.
- If the payment is not received by the 15th then the member
account will be temporarily suspended on the 17th of the month.
- If the bill is paid after the 15th then it is the member's
responsibility to furnish CBS with the proof of payment by fax or courier/mail.
- CBS will re-activate the account once the proof of late
payment is received from the member.
- Members not paying within two(2) months will be permanently
deleted from CBS database.
- Once any member is permanently deleted for non-payment, CBS
reserves the right to deny any request for fresh sign-up.
- Service Change
- A service change requires the member to send his signed
request in writing, either by FAX or by Mail (not e-mail).
- Upgrade from Anirban to Aparajita will be effective from the
beginning of the service period when CBS receives the the request for an upgrade.
- Upgrade to CBS Premium will be effective from the beginning of
the service period when CBS receives the upgrade fee of Tk. 1000.
- Any downgrade will be effective from the next service period
after receiving the request. No re-fund/adjustments of sign-up fee will be provided for
downgrading from Premium service.
- Indemnity. Members agree to defend, indemnify, and hold CBS
and its affiliates harmless from any and all liabilities, costs, and expenses, including
reasonable attorneys' fees, related to or arising from: any violation of this agreement by
you or those who access the Service through your account; and, the use of the Service or
the Internet and the placement or transmission of any message, information, software, or
other materials on the Internet by you or by those who have access to the Service through
your account.
- Term of Agreement. This Agreement is effective from your
acceptance thereof, which is indicated by your signature on the Membership Form or upon
the first use of the Service through your account, whichever is first. If you are a
current CBS member when this Agreement is activated, your continued use of the Service
constitutes your acceptance of this Agreement.
- Termination of Agreement
- Members may terminate this Agreement
by using only written and signed application. E-MAIL & VERBAL
CANCELLATIONS WILL NOT BE ACCEPTED. Charges to your account
will stop accruing from the following working day your application
receipt or
from the mentioned date in the application whichever is later.
CBS does not issue pro rata fee refunds.
- CBS may terminate this Agreement:
at any time without cause upon 30 days prior notice; or, immediately
upon notice if you, or any person who has
access to the Service through your account, commit a material
breach of this Agreement, including but not limited to a breach
of any obligation imposed in "Subscriber
Acceptable Use Policy" or you fail to pay any charges within
30 days of the date they accrue.
- Upon termination of this Agreement all rights granted to the
member under this Agreement shall immediately cease and terminate; and, the member must
destroy or return to CBS all copies of software and documentation that he/she received
from CBS.
- Termination of this Agreement does not release you from the
obligation to pay all accrued charges under this Agreement.
